These Terms of Service govern your access to and use of FormOS, including our website, dashboard, forms, integrations, plugins, applications, and related services.
By creating an account, using FormOS, publishing a form, embedding a form, installing an integration, or submitting information through a FormOS-powered form, you agree to these Terms.
If you do not agree, you must not use FormOS.
1. About FormOS
FormOS is an online form builder and workflow tool. It allows users to create forms, collect responses, upload files, capture signatures or initials, generate completed documents, send notifications, and connect with third-party tools such as Google Drive, Dropbox, WordPress, and Shopify.
FormOS provides software tools. FormOS does not provide legal, financial, medical, accounting, immigration, or professional advice.
2. Accounts
To use certain FormOS features, you must create an account.
You agree to:
Provide accurate account information
Keep your login details secure
Notify us if you suspect unauthorized access
Be responsible for activity under your account
Use FormOS only for lawful purposes
You must not share your account access in a way that bypasses plan limits, security, or billing requirements.
3. Workspaces, Staff, and Permissions
FormOS may allow account owners to invite staff or team members.
The account owner is responsible for:
Managing invited users
Assigning appropriate permissions
Removing access when no longer needed
Ensuring team members comply with these Terms
Actions taken by invited staff or workspace members may be treated as actions taken on behalf of the account owner or workspace.
4. Forms and Submissions
You are responsible for the forms you create, publish, share, or embed using FormOS.
You are responsible for:
The content of your forms
The information you request from respondents
The legal basis for collecting information
Obtaining required consent
Providing any required notices to respondents
Handling submitted information appropriately
Ensuring your forms comply with applicable laws
FormOS is not responsible for the legality, accuracy, or appropriateness of forms created by users.
5. Form Respondents
If you submit information through a FormOS-powered form, your information is provided to the form owner.
The form owner controls the purpose of the form and how submitted information is used. FormOS processes submissions on behalf of the form owner and according to our platform functionality.
If you have questions about a specific form or submission, contact the form owner first.
6. Uploaded Files and Signatures
FormOS may allow forms to collect file uploads, signatures, initials, images, documents, or other attachments.
Users must not upload or request content that is illegal, harmful, abusive, infringing, fraudulent, or unsafe.
Form owners are responsible for ensuring that file uploads and signature collection are lawful and appropriate for their use case.
FormOS does not guarantee that electronic signatures or submitted documents will satisfy the legal requirements of every jurisdiction or transaction type. You should obtain professional advice where legal enforceability is important.
7. Integrations
FormOS may connect with third-party services, including but not limited to Google Drive, Dropbox, WordPress, Shopify, Stripe, email services, and other tools.
By connecting an integration, you authorize FormOS to access and use the connected service only as needed to provide the integration.
Third-party services are governed by their own terms and privacy policies. FormOS is not responsible for third-party service outages, data handling, pricing, changes, or failures.
You may disconnect integrations where supported.
8. Google Drive and Storage Integrations
When you connect Google Drive or another storage provider, FormOS may upload files, create folders, store generated documents, and save related metadata according to your settings.
You are responsible for:
Choosing the correct storage destination
Managing access to your storage account
Ensuring uploaded files are handled appropriately
Deleting files from your storage account if required
Disconnecting a storage integration stops future uploads but does not automatically delete files already stored in your connected storage account.
9. WordPress and Shopify Apps
FormOS may provide plugins, embed tools, Shopify apps, or theme app extensions.
You are responsible for:
Installing integrations correctly
Testing forms before relying on them
Keeping plugins or apps updated
Ensuring embedded forms work with your website theme, store, or setup
FormOS does not guarantee compatibility with every WordPress theme, Shopify theme, app, plugin, browser, or custom website environment.
10. Plans, Billing, and Subscriptions
FormOS may offer free and paid plans.
Paid plans may include limits, features, quotas, user access, storage options, integrations, branding controls, ads-free options, or other plan-based functionality.
By subscribing to a paid plan, you agree to pay the applicable fees. Payments may be processed by a third-party payment provider such as Stripe.
Unless stated otherwise:
Fees are charged according to the selected billing period
Subscription features may change by plan
Failure to pay may result in downgrade, suspension, or restricted access
Taxes may apply depending on your location
Refunds are not guaranteed unless required by law or stated in a separate refund policy
You are responsible for managing your subscription and billing details.
11. Acceptable Use
You must not use FormOS to:
Violate laws or regulations
Collect information unlawfully
Impersonate another person or organization
Send spam or abusive messages
Distribute malware or harmful code
Collect payment card data unless using approved secure payment tools
Collect highly sensitive data without proper legal basis, security, and consent
Infringe intellectual property rights
Harass, threaten, exploit, or harm others
Attempt to bypass security or access controls
Interfere with FormOS systems or other users
Use FormOS for fraud, scams, phishing, or misleading activity
We may suspend or terminate accounts that violate these rules.
12. User Content
You retain ownership of the content you submit to FormOS, including forms, submissions, uploads, and related data.
You grant FormOS a limited license to host, process, transmit, display, store, and use your content only as needed to provide, secure, maintain, and improve the service.
You represent that you have the rights and permissions needed to upload, collect, or process your content through FormOS.
13. Intellectual Property
FormOS, including its software, design, branding, interface, workflows, features, documentation, and related materials, is owned by us or our licensors.
You may not copy, reverse engineer, resell, sublicense, or misuse FormOS except as permitted by these Terms.
14. Service Availability
We aim to keep FormOS reliable, but we do not guarantee uninterrupted or error-free service.
FormOS may be unavailable due to maintenance, updates, hosting issues, third-party outages, security incidents, or circumstances outside our control.
We are not responsible for losses caused by downtime, delays, data transmission errors, third-party failures, or user configuration mistakes.
15. Changes to the Service
We may update, modify, suspend, or discontinue features at any time.
We may introduce new features, change plan limits, update pricing, modify integrations, or remove features that are no longer supported.
Where practical, we may provide notice of material changes.
16. Termination and Suspension
You may stop using FormOS at any time.
We may suspend or terminate access if:
You violate these Terms
Your payment fails
Your use creates security, legal, or operational risk
You misuse integrations or third-party services
We are required to do so by law
After termination, access to forms, submissions, files, or account data may be restricted or deleted according to our retention practices.
17. Disclaimers
FormOS is provided on an “as is” and “as available” basis.
To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and error-free operation.
You are responsible for testing forms, reviewing documents, verifying workflows, and ensuring FormOS is suitable for your intended use.
18. Limitation of Liability
To the maximum extent permitted by law, FormOS and its owners, employees, contractors, partners, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, goodwill, data, business, or opportunities.
To the maximum extent permitted by law, our total liability for any claim related to FormOS will be limited to the amount you paid to FormOS in the three months before the claim, or AUD $100 if you used a free plan.
Some laws do not allow certain limitations, so some of these limits may not apply to you.
19. Indemnity
You agree to indemnify and hold FormOS harmless from claims, losses, liabilities, damages, costs, and expenses arising from:
Your use of FormOS
Your forms or submissions
Your uploaded content
Your violation of these Terms
Your violation of laws or third-party rights
Your use of third-party integrations
20. Governing Law
These Terms are governed by the laws applicable in Australia, unless another jurisdiction is required by applicable law.
You agree to attempt to resolve disputes with us informally before starting legal proceedings.
21. Changes to These Terms
We may update these Terms from time to time. When we do, we may update the effective date above.
Continued use of FormOS after changes means you accept the updated Terms.
